High Court Judge Nate Ndauendapo is set to deliver judgement on 30 April in an urgent application brought by dismissed Roads Authority executives Sidney Boois and Richard Milinga, who are seeking reinstatement to their positions.
The two former senior officials were dismissed in February following an internal disciplinary process linked to alleged procurement irregularities involving vehicles valued at about N$16 million.
In their urgent application, Boois and Milinga argued that both their dismissal and the subsequent appeal process were procedurally flawed. They argued that the employer failed to follow its own internal rules and timelines and that the appeal process was mishandled.
The legal team says the pair is challenging the fairness of the disciplinary proceedings and alleging that the employer interfered with the process.
As interim relief, they are asking the court to set aside the dismissal and order their reinstatement pending the outcome of a properly conducted appeal process.
The Roads Authority CEO, Hippy Tjivikua, has defended the company's actions, saying the matter does not meet the threshold of urgency.
Tjivikua's team also says that the matter is one to be handled by the labour office and not the High Court.
Sidney Boois served as executive officer for transportation, and Richard Milinga was the divisional manager for the transport inspectorate. The two have denied wrongdoing; they are maintaining that the procurement followed approved procedures and that no financial loss was suffered by the authority.
In email communications seen by NBC News, the Roads Authority appointed lawyers to handle the disciplinary process, cautioned the company against dismissing the two and said that the process was flawed, but Tjivikua, according to his legal department, opted for dismissal.
