Former Minister Sacky Shanghala has asked the High Court to halt his prosecution in the Fishrot case, pending a review of the investigation and legal processes that led to the charges.

The review application seeks to temporarily stop proceedings while the court examines the claims.

Shanghala also raises concerns over why some individuals who are implicated in the alleged looting of the fishing resources have not been arrested and prosecuted. 

He argues that investigations by the Anti-Corruption Commission, under the direction of its senior officials, were not conducted independently or in accordance with the law. 

He also questions the alleged involvement of the Prosecutor-General in guiding these investigations, the issuance of summonses, and the handling of information obtained from foreign jurisdictions.

In addition, Shanghala disputes warrants issued by magistrates in Windhoek and Gobabis and challenges the appointment of Deloitte & Touché for forensic work in the case. 

While his review application will be heard in the civil court, the main criminal proceedings are expected to commence with a pretrial conference on November 25.
