The bail application of NAMDIA theft accused, Joel Angula, commenced on Tuesday in the Windhoek Magistrate's Court.
Angula is one of the suspects in the NAMDIA heist, where 412 parcels of diamonds were recorded missing from the safe.
During the cross-examination, Angula's attorney, Veikko Alexander, questioned the role of investigating officer Simeon Nghilalulwa, whom he said had only attended to the scene the following day.
Nghilalulwa, however, countered that he was crucial to the investigation, gathering evidence and submitting witness statements.
He says he was the one who requested that the police reach out to the wife of Max Endjala, which is how they were able to connect the two suspects, namely Endjala and Angula.
The investigation also stated that Angula's counts of robbery as well as theft are both applicable.
He said Angula failed his duty as a protection officer at NAMDIA, having taken property that he was supposed to protect, which was later discovered at his residence.
Nghilalulwa stated that if Angula is to be granted bail, the public will lose confidence in the judiciary and the Namibian police, citing NAMDIA as a public entity and the stolen property belonging to the public.
The matter has been postponed until the 30th of January.
