The Ministry of Defence and Veterans Affairs has confirmed the authenticity of a letter which is being circulated on social media.

The letter states that Treasury received authorisation to settle a N$60.9 million civil claim with Enercon.

The claim was for "service bureau charges" under a fuel supply agreement.

According to NDF spokesperson Colonel Petrus Shilumbu, the amount covers charges from 2014 to 2024 that had not been claimed since the contract’s inception.

Shilumbu said the negotiations between the ministry and Enercon resulted in an agreement to settle the outstanding amount following a legal opinion from the Attorney General.

A letter dated 6 February 2025 from the Ministry of Finance and Public Enterprises shows the Treasury’s approval for the payment, stipulating that the settlement will be made as a full and final resolution of the claim.

Enercon and its directors are currently before the Windhoek Magistrate's Court, where the company directors, Peter and Malakia Elindi, are seeking bail.

The two brothers are among those accused of defrauding NAMCOR to the combined tune of over N$480 million.

One of the allegations is that they sold fuel storage assets that belong to the Ministry of Defense to NAMCOR.
